Terms of Service

1. The Service

gisman.app ("the Service", "the Platform") is a cloud-based GIS management platform for FTTX and utility infrastructure contractors, operated by the gisman.app team ("we", "us", "our"). By registering for or using the Service, you ("the User", "the Subscriber") agree to these Terms.

2. Account Registration

You must provide accurate, current and complete information during registration.
You are responsible for maintaining the confidentiality of your account credentials.
You must be authorised to act on behalf of your company when registering a company account.
You must be at least 18 years old to register.
One company = one Subscriber account. Sub-users are managed by the Subscriber's admin.

3. Subscription Plans and Payment

The Service is offered on paid subscription plans as described on the pricing page.
A 14-day free trial is available to new subscribers. No credit card is required to start the trial.
Subscriptions auto-renew monthly unless cancelled before the renewal date.
Payment is processed securely by Stripe. We do not store payment card details.
Prices are in EUR, excluding applicable VAT. B2B transactions within the EU are subject to reverse-charge VAT rules.
Annual plans are billed upfront and are non-refundable after 14 days from payment.
We reserve the right to change pricing with 30 days' notice to existing subscribers.

4. Free Trial

The free trial gives full access to the subscribed plan for 14 days. If you do not subscribe before the trial expires, access to editing features is suspended. Your data is retained for 90 days after trial expiry to allow you to subscribe and resume work. After 90 days without a subscription, your account and all associated data may be permanently deleted.

5. Cancellation

You may cancel your subscription at any time from the Billing page → "Manage subscription".
Cancellation takes effect at the end of the current billing period. You retain full access until then.
After cancellation, your account switches to read-only mode — you can view and export all your data.

6. Your Data — Ownership and Portability

You own your data. All GIS data, photos, work reports, measurements and documents you upload or create in gisman.app remain your property.

We do not use your project data for any purpose other than providing the Service to you.
You can export your data at any time using the in-app export functions (XLS, GeoJSON).
We will not sell, share or disclose your project data to third parties without your explicit consent, except as required by law.
By uploading data you grant us a limited licence to store, process and display it solely for the purpose of providing the Service.

7. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable regulation.
Upload data you do not have the right to use or share.
Attempt to circumvent security measures, access other subscribers' data, or reverse-engineer the platform.
Resell or sublicense access to the Service without our written consent.
Use automated tools to scrape, extract or bulk-download data beyond normal use.

8. Service Availability and Changes

We aim for high availability but do not guarantee 100% uptime. Planned maintenance will be announced in advance.
We may update, modify or discontinue features of the Service with reasonable notice.
In the event of discontinuation of the entire Service, we will provide at least 90 days' notice and means to export your data.

9. Intellectual Property

The gisman.app platform, its design, software, trademarks and documentation are our intellectual property. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service during your subscription period.

10. Liability Limitation

To the maximum extent permitted by applicable law, we are not liable for:

Loss of profits, revenue, data or business opportunities arising from use of the Service.
Errors or inaccuracies in GIS data you upload or in map tile providers.
Service interruptions or data loss not caused by our gross negligence or wilful misconduct.

Our total liability to you in any 12-month period shall not exceed the subscription fees you paid in that period.

11. Governing Law

These Terms are governed by EU law. Any disputes shall be subject to the jurisdiction of the courts of the EU member state in which the operator is established.

12. Changes to These Terms

We will notify you by email at least 14 days before making material changes to these Terms. Your continued use of the Service after the effective date constitutes acceptance. If you do not accept the new Terms, you may cancel your subscription before the effective date.
